How Musical Nexus collects, uses, and protects the information you share with us.

Musical Nexus (“we,” “our,” or “us”) is an Australian-operated community site. This Privacy Policy explains how we handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

What We Collect

Information you provide

  • Account information. When you register, we collect a username, email address, and password (stored as a one-way hash). You may optionally add a display name, avatar, cover image, bio, or links.
  • Content you submit. Songs, MML code, comments, reactions, tags, reports, and any files you upload (such as MIDI or cover art).
  • Communications. Messages you send to moderators or support, and any information you include in them.

Information collected automatically

  • Usage data. Pages viewed, songs played, reactions given, and similar activity, along with approximate timestamps.
  • Technical data. IP address, browser type and version, device type, referring page, and the URLs you request.
  • Cookies and similar technologies. See our Cookie Policy.

Information from third parties

If you choose to sign in with a third-party service (for example, Discord), we receive basic profile information from that service as permitted by your settings there. We do not receive your password.

We do not knowingly collect sensitive information (as defined in the Privacy Act) through the Site. If you send us sensitive information in a message, we treat it with the protections required by APP 3.

How We Use Information

We use your personal information to:

  • Provide, operate, and improve the Site and its features.
  • Display your username, avatar, and public content to other users.
  • Protect the Site from spam, abuse, and unauthorised access.
  • Enforce our Terms of Service and respond to reports.
  • Send you transactional email (for example, password resets or moderation notices).
  • Send optional activity notifications that you can turn off in your account settings.
  • Comply with our legal obligations and respond to lawful requests.

How We Share Information

We do not sell your personal information. We share information only in these limited situations:

  • Publicly, by your choice. Content you post (songs, comments, reactions) and your public profile are visible to anyone who can access the Site.
  • Service providers. With vendors who help us run the Site (such as hosting, storage, email delivery, and analytics), under arrangements that require them to protect your information and use it only for the services they provide to us.
  • Legal reasons. Where disclosure is required or authorised by Australian law, legal process, or to protect the rights, property, or safety of Musical Nexus, our users, or others.
  • Business transfers. In connection with a merger, acquisition, or sale of assets, with notice to affected users where required.

Overseas Disclosure (APP 8)

Musical Nexus is operated from Australia, but some of our service providers (for example, object-storage and content-delivery vendors) operate servers outside Australia, including in the United States and the European Union. By using the Site, you acknowledge that your personal information may be stored or processed in those countries. We take reasonable steps to ensure our overseas service providers handle your information consistently with the APPs; however, in some cases we may rely on your consent under APP 8.2(b), in which case APP 8.1 may not apply and Australian law may not be enforceable against the overseas recipient.

Data Retention

We retain account information for as long as your account is active. When you delete your account, we remove or anonymise your personal information within a reasonable period, except where we are required to retain it for legal, security, or fraud-prevention purposes. Public content that forms part of community discussions may be retained in an anonymised form.

Access, Correction, and Your Choices

  • Access and correction (APP 12 & 13). You may request access to, or correction of, the personal information we hold about you by contacting the site administrators. We will respond within a reasonable period and, where we can, provide access in the form you request.
  • Profile edits. You can view and update most of your profile information from your account settings without contacting us.
  • Notifications. You can adjust email and in-app notification preferences at any time.
  • Deletion. You can request deletion of your account by contacting us or using the in-app deletion option where available.

Anonymity and Pseudonymity (APP 2)

Where practical, you may interact with the Site using a pseudonym (for example, a username that does not identify you in real life). Some functions, such as account recovery, require a valid email address.

Direct Marketing

We do not send marketing messages unless you have opted in. You can opt out at any time using the unsubscribe link in any such message or by changing your notification preferences.

Security

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include hashing passwords and using HTTPS for traffic to the Site. No system is completely secure, however, and we cannot guarantee absolute security.

Children

Musical Nexus is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us so we can remove it.

Complaints

If you believe we have breached the APPs, please contact the site administrators first so we can try to resolve your concern. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of the page and, where the changes are material, provide more prominent notice on the Site.
